Jól kezelik a lefedettségi problémákat a mobilcégek
Egy Nagy-Britanniában elvégzett fogyasztóvédelmi vizsgálat szerint a szigetország egyébként rendkívül kompetitív piacán működő mobilszolgáltatók felületesen tájékoztatják az új ügyfeleket a lakóhelyükön elérhető szolgáltatás minőségéről. Nálunk a jelek szerint nincs ilyen probléma, igaz, lefedettségben is jobban állunk, mint a britek.
Elmondható, hogy Magyarország a domborzati viszonyaiból, valamint a településstruktúrájából adódóan kedvező terep a különféle rádiófrekvenciás technológiák, így többek közt a mobilhálózatok kiépítése szempontjából. Nem véletlen, hogy Európában hazánk a mobil-lefedettség tekintetében a legjobban ellátott országok közé tartozik, és bár a mobiltelefónia nem helyhez kötött szolgáltatás, így is akadhatnak olyan ügyfelek, akiknél otthon, vagy például a munkahelyükön egyáltalán nincs térerő.
Csak egészség legyen, meg térerő
A probléma a mobilinternet dinamikus előretörésével ráadásul hazánkban is kézzelfoghatóbbá vált, hiszen ezen a területen a lefedettségi mutatók közel sem érik el azt a szintet, ami a 2G-s hálózatokkal megvalósítható, és bár 2G-s technológiával is lehet internetezni, aligha lesz megelégedve az ügyfél a 10-20 kbps sávszélesség által biztosított sebességélménnyel. A Vodafone, a Telenor és a T-Mobile szerencsére többnyire megértően kezeli az ezektől az ügyfelektől érkező panaszokat, valamint igyekszik megelőző lépéseket tenni annak érdekében, hogy ne érje csalódás az új előfizetőt.
A hazai piacot vezető T-Mobile mindenekelőtt arra hívja fel a figyelmet, hogy a mobilszolgáltatás jellegéből következően nem helyhez kötött, így nem feltételezhető, hogy az ügyfél kizárólag egyetlen helyen vagy ponton kívánja azt igénybe venni. A szolgáltató Általános Szerződési Feltételei (ÁSZF) ennek megfelelően rendelkezik a szolgáltatási területről, a “mindenkori lefedettségi területben” definiálva azt.
A T-Mobile-nál az előfizető külön kérésére a szerződés megkötésekor, vagy akár előtte, a telefonos ügyfélszolgálaton tájékoztatást adnak az ügyfél által gyakran látogatott területek, vagy a lakóhely lefedettségi paramétereiről. “Ha utólagosan, a használat során derül ki, hogy a szolgáltatás használatának mégis komoly, a lefedettségből eredő korlátai vannak, és ezt ügyfelünk jelzi, egyedi elbírálás és méltányossági alapon a szerződés felbontásához és a vásárolt eszköz (pl. modem) egyidejű visszavételéhez hozzájárulunk (ez főleg hűségnyilatkozat vállalása esetén a kötbér miatt fontos momentum)” – áll a cég lapunknak eljuttatott nyilatkozatában.
A Vodafone a mobilnetes ügyfeleknek a szerződéskötést követően eleve hét napos, kötelezettségektől mentes kipróbálási időt ad, így ha a lakóhelyen nincs megfelelő 3G-s térerő, vagy a vételi viszonyok miatt a sávszélesség aránytalanul és tartósan alacsony, az ügyfelek kötbérfizetés nélkül elállhatnak a szerződéstől. A Vodafone ezzel együtt a szerződéskötéskor minden esetben nyilatkozik az ügyfél számára a lakóhelyen elérhető szolgáltatásról, és méltányosan kezeli azokat az eseteket, amikor az előfizető olyan területre költözik, ahol nincs lefedettség.
Az ügyfélnek mutatott, illetve a szolgáltatók weboldalán is szereplő lefedettségi térképek ezzel együtt a szolgáltatók szerint legfeljebb tájékoztató jellegűek: “Ha a lefedettség a lefedettségi térképen előre meg nem jósolható körülmények (így például domborzati viszonyok, épület szerkezete) miatt nem megfelelő, ez alapja lehet egy díjmentes szerződésbontásnak – ezeket az ügyeket egyedileg kezeljük, és keresünk az ügyfél számára is a megfelelő megoldást” – nyilatkozták a HWSW-nek a Vodafone sajtóosztályán.
A Telenor a Vodafone-hoz hasonlóan, azaz előzetes tájékoztatással igyekszik elébe menni a panaszos eseteknek, a norvég tulajdonú cég azonban leszögezi, nem vállal felelősséget a térképhibákért, legalábbis erre utal a szolgáltató által lapunknak küldött hivatalos álláspont: “A térképeken feltüntetett tényleges és tervezett lefedettség tájékoztató jellegű, hiszen figyelembe kell venni, hogy helyenként előfordulhatnak olyan eltérések (a mobil rádiótelefon-szolgáltatás sajátosságai – különös tekintettel az épületek hatására és az épületeken belüli üzemelésre -, illetve a térképek léptéke, stb. miatt), amelyek nem a szolgáltatás minőségének következményei, és amelyekért a Telenornak nem áll módjában felelősséget vállalni.” A mobilnetes szerződéseknél a Telenor is biztosít ötnapos, kötelezettségektől mentes kipróbálási időt.
Felelősséggel tartoznak
A Telenor álláspontját részben vitatja Utassy Roland fogyasztóvédelmi szakértő, a CP Contact fogyasztóvédelmi tanácsadócég főtanácsadója. Utassy szerint a lefedettségi térképeken szereplő adatokért, illetve az azon szereplő összes információ pontosságáért felelősséget kell vállalniuk a mobilszolgáltatóknak, éppúgy, mint egy reklámban szereplő állításért. Jogvitás esetben az elbírálás még szigorúbb lehet – hívja fel a figyelmet a szakértő -, hiszen a fogyasztó döntéséhez jelentősen hozzájárulhat ez a fajta tájékoztatás. Utassy hozzátette: a lefedettségről ajánlott írásban (például e-mailben) tájékoztatást kérni a könnyebb utólagos bizonyíthatóság miatt.
A szolgáltatási területekről a lehető legpontosabb és részletekbe menő tájékoztatás az ügyfél és a mobilszolgáltató közös érdeke, hiszen az előfizetők többnyire egy vagy két évre lekötik magukat az adott szolgáltatónál, és evidens, hogy ez alatt az idő alatt megfelelő minőségű szolgáltatást várnak el a pénzükért cserébe. Az operátoroknak ezzel együtt nyilvánvaló érdekük, hogy az előfizető elégedett legyen a szolgáltatással, hiszen a csalódott ügyfelek hamar megtalálják a módját annak, hogy különböző plénumokon hangot adjanak vélt vagy valós sérelmeiknek.
A lefedettségi térképek a Vodafone, a Telenor és a T-Mobile weboldalán egyaránt megtalálhatók, valamint az aktuális térképek az NHH oldaláról is elérhetők a havonta kiadott mobilnet-gyorsjelentés részeként.
